An Owner who is proposing building works has obligations under the Building Act 1993 to protect Adjoining property from potential damage from this work.
If building work is close to or adjacent to adjoining property boundaries, then an owner may be required to carry out protection works in respect of that adjoining property.
This is to ensure that the adjoining property is not affected or damaged by the proposed building work. (works can include excavations and building up of soil, retaining walls)
Where an application for a building permit for the proposed works has been submitted and the relevant Building Surveyor has determined that Protection Works are required, the Building Act has provision for you to apply to Council for land ownership details by completing the attached application form should contact details not otherwise be determined.
Fees
The fee is currently $69.10 per property. Please note this fee will be applicable for each individual property owner details requested.
Fees are non-refundable and valid until 1 July 2027.
How to apply
Please return the completed application form along with the required documents (Form 1 - Application for a Building permit, Form 6 Determination that protection work is required and the Owner Authorisation of Agent to make this request on their behalf) The credit card authorisation form will need to include the fee of all properties that Owner details are requested.
