Aborignal and Torres Strait Islander Public Art Commissioning Guidelines

Key principles

  • Self-determination: Recognise and support the right of Aboriginal and Torres Strait Islander artists and communities to control their cultural heritage and artistic practice.
     
  • Cultural Intellectual Property (ICIP): Understand and respect the ownership rights of Aboriginal and Torres Strait Islander people in their traditional knowledge, cultural expressions, and artistic works.
     
  • Consultation and Consent: Engage in meaningful consultation with Aboriginal and Torres Strait Islander land councils, community groups and artists, to obtain their prior, and informed consent for any use, or references to, their culture or artistic works.
     
  • Respect and Acknowledgement: Acknowledge Aboriginal and Torres Strait Islander people as the original custodians of the land and their ongoing connection to culture and heritage.
     
  • Fair and Ethical Dealings: Ensure that Aboriginal and Torres Strait Islander artists are treated fairly and transparently in all aspects of the commissioning process, including fees, contracts, and usage rights.
     
  • Building Relationships: Investing in genuine, long-term relationships with Aboriginal and Torres Strait Islander land councils, communities and artists, based on genuine intentions, transparency, trust and mutual respect.
     
  • Transparency: transparent, honest and clear communications with all stakeholders, including the land council and artist/s throughout the commissioning process.
     
  • Accountability: Be accountable to all stakeholders and ensure that the commissioning process is conducted in a culturally appropriate manner.
