Delegations & Authorisations to Staff
Delegations are a power, duty or function of the Council that are delegated to member(s) of Council staff via a formal delegation process. Delegations are a highly effective means of streamlining decision-making and enables Council staff to carry our core service activities and administrative and routine matters.
There are several ‘instruments’ Council uses to carry out its powers, duties or functions through a process of assigning responsibilities. Without the instrument mechanism, Council would simply not be able to function. Officers require due authority or power to act on matters and make important decisions on behalf of Council. When Council delegates a power, duty or function to a member of staff or committee, the decision of the delegate is deemed to be a decision of the Council.
Broadly, there are two types of written instruments which are:
- Instruments of Delegation
- Instruments of Appointment and Authorisation
These Instruments are crucial in distributing specific powers via individual “provisions” (enacted by legislation) amongst classes of position-holders within Council. Generally, powers are delegated down from Council’s CEO to Council Officers. The CEO is delegated these powers by the elected Council as the central authority from which all powers, duties or functions flow.
There are some functions, e.g. statutory decisions, which must only be exercised by a specialised Officer who has the appropriate level of delegations or authorisations in place to make those decisions, based on their qualifications and expertise.
